(Received the assent of the Governor on the 16th February, 2010 and was published both in Hindi and English in the Rajpatra, Himachal Pradesh, dated 19th February, 2010, pp. 6811-6813).
An Act to repeal the Himachal Pradesh Prohibition of Smoking and Non-Smokers Health Protection Act, 1997 (Act. No. 17 of 1997).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixtieth Year of the Republic of India as follows :—
1. Short title.- This Act may be called the Himachal Pradesh Prohibition of Smoking and Non-Smokers Health Protection (Repeal) Act, 2009.
2. Repeal of Act No. 17 of 1997 and savings.- (1) The Himachal Pradesh Prohibition of Smoking and Non-Smokers Health Protection Act,1997 is hereby repealed.
(2) Notwithstanding such repeal, any investigation, legal proceedings, penalty, forfeiture or punishment accrued or incurred under the Act so repealed, shall be continued or enforced and any such penalty, forfeiture or punishment may be imposed as if the said Act had not been repealed.
