Salaries and Allowances of the Speaker and the Deputy Speaker of the Legislative Assembly (Tripura) Act, 1972

TRIPURA ACT 002 OF 1972

An Act to provide for the salaries and allowances of the Speaker and the Deputy Speaker of the Legislative Assembly of Tripura.

Be it enacted by the Legislative Assembly of Tripura in the Twenty-third Year of the Republic of India as follows:

Section 1. Short title and commencement

(1) This Act may be called the Salaries and Allowances of the Speaker and the Deputy Speaker of the Legislative Assembly (Tripura) Act, 1972.

(2) It shall be deemed to have come into force on the twentieth day of March, 1972.

Section 2. Definitions

In this Act, unless the context otherwise requires

(a) Assembly means the Legislative Assembly of Tripura;

(b) Deputy Speaker means the Deputy Speaker of the Assembly;

(c) Member means a member of the Assembly not being the Chief Minister, a Minister or Minister of State or Deputy Minister; and

(d) Speaker means the Speaker of the Assembly.

Section 3. Salaries and allowances or the Speaker

The Speaker shall be paid such salary, conveyance allowance, travelling allowance, daily allowance and shall be entitled to such amenities regarding residence and motor car as are provided for a Minister other than the Chief Minister, a Minister of State and a Deputy Minister, under the Salaries and Allowances of Ministers (Tripura) Act, 1972 and rules made thereunder.

Section 4. Sumptuary allowance of the Speaker

The Speaker shall be entitled to a sumptuary allowance of rupees 1[one thousand] per month.

Section 5. Speaker and Deputy Speaker not to practise any profession

The Speaker and the Deputy Speaker shall not practise any profession or engage in any trade or receive any money for employment other than their duties as the Speaker or the Deputy Speaker, as the case may be.

Section 6. Salaries and allowances or Deputy Speaker

The Deputy Speaker shall be paid such salary, conveyance allowance, travelling allowance and daily allowance and shall be entitled to such amenities regarding residence and motor car as are provided for a Minister of State under the Salaries and Allowances of Ministers (Tripura) Act, 1972 and rules made thereunder.

2[6-A. Sumptuary Allowance of Deputy Speaker. The Deputy Speaker shall be entitled to receive a Sumptuary Allowance of rupees 3[one thousand] per month.

Section 7. Medical facilities or the Speaker and Deputy Speaker

The Speaker and the Deputy Speaker and the members of their families shall be entitled free of charge to accommodation in hospitals maintained by the Government and also to medical treatment in accordance with the Medical Attendance Rules, as amended from time to time, applicable to Class I, Officers serving in connection with the State of Tripura.

Section 8. Advance to the Speaker and the Deputy Speaker for purchase or motor cars

There may be paid to the Speaker or the Deputy Speaker by way of a repayable advance such sum of money as may be payable to a Minister under the Salaries and Allowances of Ministers (Tripura) Act, 1972 and rules made thereunder for the purchase of a motor-car in order that he may be able to discharge conveniently and efficiently the duties of his office.

Section 9. Speaker and Deputy Speaker not to draw any salary as a member

The Speaker and the Deputy Speaker shall not be entitled to receive any sum out of the funds provided by the Assembly by way of salary and allowances to members thereof.

Section 10. Notification respecting appointment of Speaker etc. to be conclusive evidence thereof

The date on which any person became, or ceased to be, a Speaker or a Deputy Speaker shall be published in the Official Gazette and any such notification shall be conclusive evidence of the fact that he became, or ceased to be, the Speaker or the Deputy Speaker, as the case may be, on that date for all the purposes of this Act.

Section 11. Repeal of Act No. 7 of 1964

The Salaries and Allowances of the Speaker and the Deputy Speaker of the Legislative Assembly (Tripura) Act, 1964 is hereby repealed.
