Salaries and Allowances of the Speaker and the Deputy Speaker of the Legislative Assembly (Pondicherry) Act, 1964

PUDUCHERRY ACT 015 OF 1964

An Act to provide for the salaries and allowances of the Speaker and the Deputy Speaker of the Legislative Assembly of Pondicherry.

Be it enacted by the Legislative Assembly, of Pondicherry in the Fifteenth Year of the Republic of India as follow:

Section 1. Short title and commencement

(1) This Act may be called the Salaries and Allowances of the Speaker and the Deputy Speaker of the Legislative Assembly (Pondicherry) Act, 1964.

(2) It shall come into force at once.

Section 2. Definitions

In this Act, unless the context otherwise requires

(a) Assembly means the Legislative Assembly of Pondicherry;

(b) member means a member of the Assembly not being a Minister;

(d) Deputy Speaker means the Deputy Speaker of the Assembly.

Section 3. Salary and allowances, etc., of the Speaker

1[ (1) The Speaker shall be paid such salary, conveyance and travelling and daily allowances and shall be entitled to all amenities including those regarding residence and motor-car and repayable advance for purchase of a motor-car, as are provided for a Minister other than the Chief Minister and the Deputy Minister under the Salaries and Allowances of Ministers (Pondicherry) Act, 1964 and the rules made thereunder.

(2) The Speaker shall also be paid a sumptuary allowance of one hundred rupees per mensem.].

Section 4. Speaker not to practice any profession

The Speaker shall not practice any profession or engage in any trade or receive any money for employment other than his duties as Speaker.

Section 5. Salary and allowances etc., of the Deputy Speaker

2[ The Deputy Speaker shall be paid such salary, conveyance and travelling and daily allowances and shall be entitled to all amenities including those regarding residence and motor-car and repayable advance for purchase of a motor-car, as are provided for a Deputy Minister under the Salaries and Allowances of Ministers (Pondicherry) Act, 1964 and the rules made thereunder.].

Section 6. Medical facilities to Speaker and Deputy Speaker

The Speaker and the Deputy Speaker and the members of their families shall be entitled free of charge to accommodation in hospitals maintained by the Government and also to medical treatment in accordance with the Medical Attendance Rules, as amended from time to time, applicable to Class I Officers serving in connection with the administration of the Union territory of Pondicherry.

Section 7. Speaker and Deputy Speaker not to draw any salary as members of the Assembly

The Speaker and the Deputy Speaker shall not be entitled to receive any sum out of funds provided by the Assembly by way of salary or allowances in respect of their membership of such Assembly.

Section 8. Notification respecting appointment of Speaker, etc., to be conclusive evidence thereof

The date on which any person became or ceased to be a Speaker or Deputy Speaker shall be published in the Official Gazette of the Union territory of Pondicherry and any such notification shall be conclusive evidence of the fact that he became or ceased to be the Speaker or the Deputy Speaker on that date for all the purposes of this Act.
