Punjab Labour Welfare Fund (Haryana Amendment) Act, 2007*

An Act further to amend the Punjab Labour Welfare Fund Act, 1965, in its application to the State of Haryana.
Be it enacted by the Legislature of the State of Haryana in the Fifty-eighth Year of the Republic of India as follows:-

1. Short title.- This Act may be called the Punjab Labour Welfare Fund (Haryana Amendment) Act, 2007.
2. Amendment of section 2 of Punjab Act 17 of 1965.- In section 2 of the Punjab Labour Welfare Fund Act, 1965 (hereinafter referred to as the principal Act),-
(i) for clause (2), the following clause shall be ??? namely:-
"(2) ‘employee’ means any person employed, directly by or through any agency (including a contractor) with or without the knowledge of the principal employer, for rem iteration in any factory or establishment to do any work connected with its affairs;";
(ii) for clause (4), the following clause shall be substituted namely:-
"(4) ‘establishment’ means a factory and includes any premises including the precincts thereof wherein and in any part of which any industry within the meaning of clause (j) of section 2 of the Industrial Disputes Act, 1947 (Act 14 of 1947), ts carried on and also includes a shop or a commercial establishment within the meaning of the Punjab Shops and Commercial Establishments Act, 1958 (Punjab Act 15 of 1958), in which, on any ??? day on more employees ??? employed on were employed during the ??? twelve months"
3. Amendment of section 9 of Punjab Act 17 of 1965.- In clause (b) of sub-section (3) of suction 9 of the principal Act.-
(i) the words "June anti" shall be omitted,
(ii) for the words "three years", the words "two years" shall he substituted.
4. Amendment of section 9A Punjab Act 17 of 1965.- In section 9A of the principal Act-
(i) in sub-section (1) for the words "one rupee" and "two rupees", the words "five rupees" and "ten rupees" shall respectively be substituted;
(ii) alter sub-section (3). the following sub-section shall be added at the end, namely:-
"(4) Any employer who fails to pay the contribution amount within a period of one month from the date specified under sub-section (2), shall be liable to pay interest at the rate of twelve percent per annum from the said date until such time the amount is actually deposited with the Welfare Commissioner."
5. Omission of section 26 of Punjab Act 17 of 1965.- Section 26 of the principal Act shall be omitted.
6. Amendment of section 26A of Punjab Act 17 of 1965.- In section 26A of the principal Act.-
(i) in clause (a), for the words "five hundred rupees", the words "five thousand rupees but not less than two thousand rupees" shall he substituted;
(ii) in clause (b) for the words "one thousand rupees", the words ten thousand rupees but not less than three thousand rupees" shall be substituted.
