THE PROHIBITION OF SMOKING IN
PASSENGER VEHICLES ACT, 1953.

1. ( I ) This Act may bc called the Prohibirion of Smoking in Shofi~iflc.

2. In this Act "passenger vehicle" means- Delinilion. ( i ) a lmm-car, or
(ii) a motor vehicle having sealing capacily for more than six persons, excluding the driver, I
which carries passengers for hire or reward at separarc farfs paid by or for individual passengers, eirher for thc wholc or for a stage of a
journcy.
3. Whoever smokes in a passengcr vchiclc while such vehicle is carrying passengcrs shaIl be punishable with fine which for a firs1 offcncc may cxtcnd to lwenry rupcs and for a second or subsequent offcncc to onc hundred rupees.
4. (1) Thc conductor of a passcngcr vehiclc in whose presence a
pcrson commits an offcnce punishable under section 3, may request such
pcrson 10 dcsisr from smoking. and if such person fails to comply with thc rcqucst he may slop the vchjcle and call for a police-officer; and thc policc-orficer map arrew such person without warrant, if, whcn ilskcd by thc policc-officer 10 give his nune and address, such person-
