*Orissa Municipal Corporation (Amendment) Act, 2003**

An Act to Amend the Orissa Municipal Corporation Act, 2003.
Be it enacted by the Legislature of the State of Orissa in the Filly-fourth Year of the Republic of India as follows:-

1. Short title and commencement.- (1) This Act may be called the Orissa Municipal Corporation (Amendment) Act, 2003.
(2) It shall be deemed to have come into force on the 27th day of July, 2003.
2. Amendment of section 70.- In section 70 of the Orissa Municipal Corporation Act, 2003 (Orissa Act 11 of 2003) (hereinafter referred to as the principal Act), in sub-section (3), for clause (m), the following clause shall be substituted, namely:-
"(m) has more than two children:
Provided that the disqualification under this clause shall not apply to a person who had more than two children on the date of commencement of the Orissa Municipal (Amendment) Act, 1994 (Orissa Act 11 of 1994), or, as the case may be, within a period of one year of such commencement, unless he begot an additional child after the said period of one year; or".
3. Amendment of section 78.- In section 78 of the principal Act, for sub-sections (3), (4) and (5), the following sub-sections shall respectively be substituted, namely:-
"(3) At every election where a poll is taken, voles shall be counted by or under the supervision and direction of the Returning Officer and each contesting candidate or, in his absence, a representative duly authorised by him in writing shall have a right to be present at the time of counting.
(4) The counting of votes shall be on such day, place and hour as may be prescribed.
(5) When the counting of votes has been completed, the Returning Officer shall, in the absence of any direction by the Election Commission to the contrary, forthwith declare the result of the election in the manner as may be prescribed.".
4. Repeal and savings.- (1) The Orissa Municipal Corporation (Amendment) Ordinance, 2003 (Orissa Ordinance No. 4 of 2003) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act.
