Himachal Pradesh Panchayati Raj (Second Amendment) Act, 1990*

An Act further to amend the Himachal Pradesh Panchayati Raj Act, 1968 (Act No. 19 of 1970).
Be it enacted by the Legislative Assembly of Himachal Pradesh in the Forty-first Year of the Republic of India, as follows:-

1. Short title:- This Act may be called the Himachal Pradesh Panchayati Raj (Amendment) Act, 1990.
2. Amendment of section 74.- For the word "The election" occurring in the beginning of sub-section (3) of section 74 of the Himachal Pradesh Panchayati Raj Act, 1968 (hereinafter called the principal Act), the words "Subject to the provisions of section 75, the election" shall be substituted.
3. Amendment of section 75.- In sub-section (1) of section 75 of the Principal Act,-
(a) before the first existing provision the following proviso shall be inserted, namely:-
"Provided that the said period may, where the general election to the Gram Panchayats are due to be held within a period of one year from the expiry of the prescribed term of the office of the Chairman or Vice-Chairman of the Panchayat Samiti, be extended by the State Government for a period till the election of their successors is notified under sub-section (1) of section 68 of the Act; but it shall not be extended in any case beyond a period of one year from the expiry of their prescribed term:" and
(b) In the existing first proviso after the word "Provid", the word "further" shall be nserted.
