Gujarat Municipalities (Amendment) Act, 1990*

An Act further to amend the Gujarat Municipalities Act, 1963.
It is hereby enacted in, the Forty-first Year of the Republic of India as follows:-

1. Short title and commencement.- (1) This Act may be called the Gujarat Municipalities (Amendment) Act, 1990.
(2) It shall he deemed to have come into force on the 9th April, 1990.
2. Amendment of section 2 of Guj. 34 of 1964.- In the Gujarat Municipalities Act, 1963 (Guj. 34 of 1964) (hereinafter referred to as "the principal Act"), in section 2 for, clause (12A), the following clause shall be substituted, namely:-
"(12A) "list of voters" means a list of voters published under sub-section (2) of section 9 for a ward within the meaning of that expression in sub-section (1) of section 7."
3. Amendment of section 7AA of Guj. 34 of 1964.- In the principal Act, in section 7AA, clause (c) shall be deleted.
4. Substitution of section 9 of Guj. 34 of 1964.- In the principal Act, for section 9, the following section shall be substituted, namely:-
"9. List of voters for every ward.- (1) For every ward, there shall be a list of voters.
(2) The list of voters shall be the same as the electoral roll of the Gujarat Legislative Assembly prepared, and revised in, accordance with the provisions of the Central law for the time being in force, which shall be published by such officer as may be designated by the Collector in this behalf in respect of a municipal borough in the manner prescribed by rules made under section 277.
(3) No person shall be entitled to have his name included in the list of voters for more than one ward and for any ward more than, once.
(4) The list of voters for any ward published under sub-section) shall remain in operation until, a revised list of voters in respect of a municipal borough is so published."
5. Deletion of sections 9A to 9J of Guj. 34 of 1964.- In the principal Act, sections 9A to 9J (both inclusive) shall be deleted.
6. Amendment of section 14 of Guj. 34 of 1964.- In the principal Act, in section 14, in sub-section (7), for the words, brackets, figures and letter "sub-section (6) of section 9C", the words, brackets and figures "sub-section (2) of section 9" shall be substituted.
7. Repeal and savings.- (1) The Gujarat Municipalities (Amendment) Ordinance, 1990 (Guj. Ord. 1 of 1990) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act.
