(1) This Act may be called the Chhattisgarh Special Police Establishment (Repeal) Act, 2003.

(2) It shall come into force from the date of its publication in the Gazette.

(1) The Chhattisgarh Special Police Establishment Act, 1947 (No. 17 of 1947) is hereby repealed and the Special Police Establishment created under the said Act is dissolved.

(2) All assets and liabilities of the aforesaid Special Police Establishment shall be vested in the State Government which shall have powers to lake possession of, recover and otherwise deal with such assets and discharge such liabilities;

(3) The State Government may by order entrust matters pending in the aforesaid Special Police Establishment to any other organize which shall deal with such matters there after:

Provided that those matters referred to the aforesaid Special Police Establishment before its dissolution by the Chhattisgarh Lok Aayog shall stand transferred to the agency appointed by the State Government under section 13(5) of the Chhattisgarh Lok Aayog Adhiniyam, 2002 (No. 30 of 2002).

(4) All actions taken by the aforesaid Special Police Establishment before; its dissolution shall be deemed to have been taken by the agency or organization as the case may be referred to in sub-sections (3) and in any proceedings before any court in which the aforesaid Special Police Establishment is a party, it shall be deemed to be substituted by the agency or organization aforementioned, as the case may be.
