BIHAR SCHOOL EXAMINATION BOARD (AMENDMENT) ACT 2011

ACT
TO AMEND THE BIHAR SCHOOL EXAMINATION BOARD ACT, 1952
BE it enacted by the Legislature of the state of Bihar in the Sixty Second year of the Republic of India as follows :-

1. Short title, extent and commencement.- (1) This Act may be called the Bihar School Examination Board (Amendment) Act 2011.
(2) It shall extend to whole of the State of Bihar.
(3) It shall come into force from the date of its publication in the official Gazette.
2. Amendment of Section- 2(d) of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).- Section-2 (d) of Bihar School Examination Board Act 1952 ( Bihar Act 7 of 1952) shall be substituted by the following :-
" (d) "High School" means a school having establishment permission or a recognized school or department of a recognised school imparting instructions in secondary education and recognised as such."
3. Amendment of Section-4 of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).- In clause (b) of Subsection- (1) the words "Director, of public Instruction, Bihar" shall be substituted by "Director, Secondary Education, Bihar.".
4. Amendment of Section-4 B of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).- In Subsection (1) and (2) of Section-4 B of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952) the words "Director, of public Instruction, Bihar" shall be substituted by "Director, Secondary Education, Bihar."
5. Amendment of Section-7 of Bihar School Examination Board Act 1952 ( Bihar Act 7 of 1952).-Subsection (1) (2) and (3) of section-7 of Bihar School Examination Board Act 1952 ( Bihar Act 7 of 1952) shall be substituted by the following:-
(1) committees of courses- A committee of courses shall be constituted by the Board for each faculty of subjects and every such committee shall consist of five members who shall be subject experts.
(2) Every committee constituted under sub-section (1) shall consist of-
(I) One person nominated by the Director, Secondary Education, Bihar.
(II) One person nominated by the Director, State Council of Educational Research and Training Bihar.
(III) Two Senior Principals/Teachers of Secondary and Senior Secondary Schools and Degree Colleges nominated by the Chairman of the Board.
(IV) One person nominated by the Director, National Council of Educational Research and Training New Delhi.
(3) It shall be the duty of the Committees-
(a) to recommend to the State Government through the Board and the State Council of Educational Research and Training Bihar, the courses of study taught at the secondary stage in secondary schools or senior secondary schools in their respective subjects;
(b) to give such instructions as may be prescribed to the ''Bihar State Text Book Publishing Corporation Ltd. Patna'' for the preparation of text books in accordance with the approved courses of study;
(c) To recommend to the Director, Secondary Education, Bihar text books for secondary schools or senior secondary schools classes at the secondary stage, other than those published by the Bihar State Text Book Publishing Corporation Ltd. Patna;
(d) To suggest improvements in the courses of study and methods of teaching classes at the secondary stage in high schools; and
(e) to perform such other functions in consistent with the purposes of this Act as may from time to time by entrusted to it by the Director, Secondary Education, Bihar.

6. Amendment of Section-8 of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).- Section-8 of the Bihar School Examination Board Act 1952 ( Bihar Act 7 of 1952) shall be substituted by the following :-
8 (1) Officers of the Board - The following shall be the officers of the Board, namely:-
(i) the Chairman
(ii) the Secretary
(iii) the Director Academic
(iv) the Joint Secretary (Senior Secondary)
(v) the Joint Secretary (Secondary)
(vi) the Controller of Examination (Senior Secondary)
(vii) the Controller of Examination(Secondary)
(viii) the Finance Officer, and
(ix) Such other officers as may be prescribed by rules made under this Act to be officers of the Board; and
8 (2) Besides the Chairman and the Secretary, the power and duties of the officers mentioned in sub-section (1) of section-8 shall be decided by the Board with the approval of the administrative department.
7. Amendment of sub section (4) of section-10 B of the Bihar School Examination Board Act 1952 as amended.- The words "Principal Secretary, Human Resource Development Department, Govt. of Bihar" of sub section (4) of section 10 B of said Act shall be substituted by words "State Government."
8. Amendment of Section-10 C of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952) as amended.- The following shall be inserted after first proviso of Section-10 C of Bihar School Examination Board Act 1952:—
Provided further that Board may frame regulation laying down criteria for constitution of Governing body/ Management committee.
9. Amendment of Section-12 of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).-(1) In clause (f) of Section-12 of the Bihar School Examination Board Act 1952 ( Bihar Act 7 of 1952) following shall be substituted-
(f) Payment of grants among secondary schools and senior secondary schools to enable such schools to introduce revised courses of studies and to make other improvements;
(2) In first proviso of clause (i) of Section-12 the words "Director, of public Instruction, Bihar" shall be substituted by "Director, Secondary Education, Bihar."
10. Amendment of Section-17 of Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952).-In Section-17 of the Bihar School Examination Board Act 1952 (Bihar Act 7 of 1952) the words "State Government" shall be substituted by the words
"Administrative Department".
