An Act to repeal the Andhra Pradesh College Service Commission Act, 1985
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the fifty-second year of the Republic of India as follows;
STATEMENT OF OBJECTS AND REASONS
The Andhra Pradesh College Service Commission was established based on the recommendations of the Three Man Committee headed by Justice P. Jaganmohan Reddy. The main object of the Commission was to streamline the procedure of selection of talented teaching staff of Government Degree and Junior Colleges as well as Private Degree and Junior Colleges in the State. Subsequently the Commission was divested with the selection of teaching staff of private col leges but entrusted the work of selection to the posts of teachers faculty positions in Government Polytechnic Colleges in the State. At present the College Service Commission is functioning as a recruiting agency to make direct recruitment to posts of teaching staff under the purview of Government Degree/Junior and Polytechnic Colleges and functioning as Departmental Promotion Committee for making recruitment under the method of recruitment by transfer i.e., on promotion in the respective cadres coming under the teaching staff. In addition to the above recruitment, with the accreditation of the University Grants Commission, Government have entrusted the responsibilities of conducting the National Eligibility Test for awarding lecturer ship and University Grants Commission Scales. This test, under the name of State Level Eligibility Test, is now being held twice a year as per the norms prescribed by University Grants Commission from time to time. In order to avoid duplication of work discharged by A.P. Public Service Commission and A.P. College Service Commission in recruitment of Government staff, it is proposed to abolish the College Service Commission by repealing the A.P. College Service Commission Act, 1985 and to save the expenditure incurred on payment of salaries and allowances to the members, and staff of the Commission.
This Bill seeks to give effect to the above decision.
(1) This Act may be called the Andhra Pradesh College Service Commission (Repeal) Act, 2001.
(2) It shall come into force in such date as the State Government may, by notification, appoint.
(1) The Andhra Pradesh College Service Commission Act, 1985 is hereby repealed.
(2) Upon such repeal,
(a) The Andhra Pradesh College Service Commission established under section 3 of the said Act shall stand abolished and all institutions together with the staff under the control of the Commission shall be transferred to such authority as the Government may, by notification in the Andhra Pradesh Gazette, specify;
(b) all obligations and liabilities incurred, all contracts entered into, all matters and things engaged to be done by the Commission shall he deemed to have been incurred, entered into, or engaged to be done by, with or for the authority specified under clause (a);
(c) all property/movable and immovable and all interests of whatsoever nature and kind therein invested in the Commission shall with all rights of whatsoever description used, enjoyed or possessed by the Commission vest in the authority specified under clause (a);
(d) all rates, fees, rents and other sums of money due to the Commission shall be deemed to be due to the authority specified under clause (a); and
(e) all suits, Prosecutions and other legal proceedings instituted or which might have been instituted by or against the Commission may be continued or be instituted by or against the authority specified under clause (a).
