An Act Further to Amend the Andhra Pradesh Universities Act, 1991
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the fifty-second year of the Republic of India as follows:-

STATEMENT OF OBJECTS AND REASONS
According to clause (22) of section 2 of the Andhra Pradesh Universities Act, 1991, the word, "Teachers" means Professors, Readers, and Lecturers in a college and such other persons giving instructions in a college as may be declared by the statutes to be teachers. As per orders issued in G.O.Ms. No. 590, Education (U.E.I.-1) Department, dated 5-5-1998, the Government for the purpose of uniform designation, the nomenclature of the Lecturers and Readers have been redesignated as Assistant Professor and Associate Professors respectively. It has therefore been decided to amend the Act suitably for redesignating Lecturers and Readers as Assistant Professors and Associate Professors respectively with effect from 5-5-1998.
Government in G.O.Ms. No. 67, H.E. (U.E.II.-1) Department, dated 4-4-2000, have forumalted the career Advancement Scheme for the reaching posts in the Universities by constituting a Selection Committee. As there is no specific provision for constitution of Selection Committee for selection of teachers under the Career Advancement Scheme in the Andhra Pradesh Universities Act, 1991, it has been decided to amend the said Act suitably.
This Bill seeks to give effect to the above decisions.
1. Short title and commencement.- (1) This Act may be called the Andhra Pradesh Universities (Amendment) Act, 2001.
(2) Section 2 shall be deemed to have come into force on and from the 5th may, 1998 and section 3 shall come into force on such date as the State Government may, by notification, appoint.
2. Substitution of words "Readers" and "Lecturers" with the words "Associate Professors" and "Assistant Professors".- In the Andhra Pradesh Universities Act, 1991 (Act 4 of 1991) (hereinafter referred to as Principal Act),-
(i) for the word", "Readers", wherever it occurs, the words, "Associate Professors" shall, be substituted.
(ii) for the word, "Lecturers", wherever it occurs, the words, "Assistant Professors", shall be substituted.
3. Insertion of New section 43-A.- After section 43 of the Principal Act, the following new section shall be inserted, namely:-
43-A-(1) "Constitution of Selection committee for Career Advancement Scheme.- There shall be constituted a the selection of Assistant Professors, Associate Professors and Professors of university colleges under the Career Advancement Scheme which shall consist of the following, namely:-
| (i) the Vice Chancellor | Chairman; |
| (ii) the Head of the concerned Department | Member; |
| (iii) two experts on the subject from outside the University to be nominated by the Vice-Chancellor | Members; |
| (iv) the Principal of the concerned university College | Member; |
| (v) the Commissioner of Collegiate Education or his nominee | Member; |
| and | |
| (vi) the Registrar | Secretary. |
Provided that no person shall participate in the meetings of the selection committee if he or his near relative is a Candidate for selection under the Career Advancement Scheme:
Provided further that no teacher holding a post lower in rank than the one to which appointment is to be made, shall be a member of selection committee.
(2) The quorum shall be five members including the Chairman and two experts on the subject and the Commissioner of Collegiate Education or his nominee.
(3) Provisions shall be made in the Statutes in respect of such matters as may be considered necessary and not provided for in sub-sections (1) and (2) in order to ensure fair selections."
