An Act to Amend the Andhra Pradesh Fire Service Act, 1999
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the fifty-first Year of the Republic of India as follows:-
1 The following Act of the Andhra Pradesh Legislative Assembly received the assent of the Governor on the 30th September, 2000 and the said assent is hereby first published on the 3rd October, 2000 in the Andhra Pradesh Gazette for general information:-
STATEMENT OF OBJECTS AND REASONS
When the Andhra Pradesh Fire Service Bill, 1998 (L.A. Bill No. 15/96) which was reserved by the Governor on the 20th May, 1999 for consideration and assent of the President under article 254(2) of the Constitution of India was sent to the Government of India, the Ministry of Urban Affairs and Employment and Ministry of Home Affairs have suggested certain amendment to the said Bill. The Government of Andhra Pradesh, while giving an undertaking to make the amendments suggested to the said Bill before bringing the Act in to force, has requested the Government of India to obtain the assent of the President at India to the said Bill in the form already passed by Andhra Pradesh Legislative Assembly.
Accordingly, on the assent of the President of India on the 1st June, 1999 the Andhra Pradesh Fire Service Act, 1999 was published in the Andhra Pradesh Gazette on 11th June, 1999 as A.P. Act 15/99.
Now the Government have accordingly decided to amend the Clause (J) of Section 2 and Sub-sections (1) and (2) of section 13 of the Andhra Pradesh Fire Service Act, 1999 as suggested by the Ministry of Urban Affairs and Employment and Ministry of Home Affairs of the Government of India.
This Bill seeks to give effect to the above decision.
1. Short title extent and commencement.- (1) This Act may be, called the Andhra Pradesh Fire Service (Amendment) Act, 2000.
(2) It extends, to the whole of the State of Andhra Pradesh.
(3) It shall come into force on such date as the Government, may, by notification in the Andhra Pradesh Gazette, appoint.
2. Amendment of section 2.- In the Andhra Pradesh Fire Service Act, 1999 (hereinafter referred to as the principal Act), in section 2, in clause (j), for the expression "National Building Code of India 1983" the expression "National Building Code of India, 1997" shall be substituted.
3. Amendment of section 13.- In section 13, of the principal Act,-
(i) for sub-section (1) the following shall be substituted, namely:-
"(1) Any person proposing to construct a high-rise building or a building proposed to be used for any purpose other than residential purpose or a building proposed to be used for residential purpose of more than 15 meters in height such as group housing, multi-storey flats, walk-up apartments, etc., shall apply to the Director General or any member of the service duly authorised by him in this behalf, before submission of such building plans to the authority or officer competent to approve the same under the relevant law, for the time being in force, for a no objection certificate along with such fee as may be prescribed.";
(ii) in sub-section (2), for the expression "the National Building Code of India, 1983", the expression "the National Building Code of India, 1997", shall be substituted.
