Andhra Pradesh Co-operative Spinning Mills (Regulation) (Amendment) Act, 1995*

An Act farther to amend the Andhra Pradesh Co-operative Spinning Mills (regulation) Act, 1983.
Whereas he Bill further to amend the Andhra Pradesh Co-operative Spinning Mills (Regulation) Act, 1983, which has been introduced in the Legislative Assembly of the State, has not ben passed by the Legislative Assembly.
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the Forty-sixth Year of the Republic of India as follows:-

1. Short title and commencement.- (1) This Act may be called the Andhra Pradesh Co-operative Spinning Mills (Regulation) (Amendment) Act, 1995.
(2) It shall be deemed to have come into force on the 30th May, 1994.
2. Insertion of new section 5-A.- In the Andhra Pradesh Co-operative Spinning Mills (Regulation) Act, 1983, (Act 15 of 1983) after section 5, the following section shall be inserted, namely:-
5A. Power to amend the Schedule.- (1) The" Government may, by notification, after or add to or cancel any item in the Schedule.
(2) where a notification has been issued under sub-section (1) there shall, unless the notification is in the meantime rescinded be introduced in the Legislative Assembly, as soon as may be, but in any case during the next session of the Legislative Assembly following the date of the issue of the notification, a Bill on behalf of the Government, to give effect to the alteration, addition or cancellation as the case may be, of the Schedule specified in the notification, and the notification shill cease to have effect when such Bill becomes law, whether with or without modifications but without prejudice to the validity of anything previously done thereunder:
Provided that if the notification under sub-section (1) is issued when the legislative Assembly is in session, such a Bill shall be introduced in the Legislative Assembly during that session:-
Provided further that where for any reason a Bill as afore said does not become law within six months from the date of it introduction in the Legislative Assembly, the notification shall cease to have effect on the expiration of the said period of six months,
(3) All references made in this Act to any item in the Schedule shall be construed as relating to the item in the Schedule as for the time being amend ed in exercise of the powers conferred by this section."
3. Repeal of Ordinance 13 of 1994.- The Andhra Pradesh Co-operative Spinning Mills (Regulation) (Second Amendment) Ordinance 1994 is hereby repealed.
